M&PL Risks are More Expensive Than Ever

In 2026, an increase in massive jury awards and settlements puts your organization at a bigger risk when it comes to Management and Professional Liability (M&PL) lawsuits.

Termination, discrimination, and retaliation suits are resulting in nuclear, multimillion-dollar verdicts, while emerging trends are creating new vulnerabilities for employers. Attorneys at the McCalmon Group are seeing a rise in lawsuits regarding the following issues:

  • Preference hiring

  • New definitions of DEI

  • Pregnancy disability

  • Religious tolerance (specifically regarding religious objections over vaccinations and antisemitism)

Fortunately, policyholders with M&PL coverage through Philadelphia Insurance Companies (PHLY) have access to a no-cost risk management tool to help anticipate these issues before they result in a claim. PHLY Executive Risk Consultant, Craig Hand, hosted a recent webinar with The McCalmon Group’s President and Founder, Jack McCalmon, Esq., to share more about this great resource.

“This was developed by Jack McCalmon and his team exclusively for PHLY,” Craig said. “If you have Employment Practices coverage with us, you have access to the PHLYGateway.”

What Can I Access Through the PHLYGateway?

Best Practice Help Line

One of the most valuable tools offered through the PHLYGateway is the Best Practice Help Line. A best practice consultation through the Best Practice Help Line provides risk-mitigation guidance from an experienced McCalmon Group attorney, applying proven strategies to reduce employment practices and workplace risks based on your unique situation.

Get your questions answered from a licensed professional about the following employer-employee relations issues: terminations, discrimination, harassment, layoffs, discipline, hiring, return-to-work, policies and procedures, theft, fraud, threats of violence, investigations of wrongdoing, crisis management, lowering exposure, incident intake, and other workplace events.

On-Demand Training

The PHLYGateway offers 35 on-demand training modules. These courses are written by McCalmon attorneys with content specific to your state.

“We’re always updating our policies, and we’re always updating our training,” Jack explained. “And we also provide the training as state-specific, so if you’re in California, you can meet your state requirements. If you’re in New York, you can meet your state requirements. If you’re in New York City, you can meet the New York City requirements, which require you to meet New York and New York City regulations.”

Each organization with access to the PHLYGateway is allowed unlimited users, meaning all of your employees can train on demand. Similar training courses have a market rate of $45 per trainee, per module, but all modules within the PHLYGateway are offered at no-cost to PHLY’s M&PL policyholders.

Sample Policies and Procedures

Access sample policies and procedures along with model handbooks. These resources are written by McCalmon attorneys, updated annually (or as legislation warrants), and specific to your state, region, and industry.

Similar attorney-drafted policies might be billed for 10 attorney hours at a market rate of $400 per hour, meaning every download from the PHLYGateway saves you $4,000!

Article Archive

With new verdicts constantly changing the M&PL risk management landscape, staying on top of trends is crucial. The McCalmon Group produces new content weekly on the PHLYGateway, now boasting a library of more than 22,000 articles.

Additionally, users can find podcasts, videos, and over 6,000 checklists on various employment topics.

“We write multiple pieces every week. We’re pulling data from losses that we’re seeing, and new laws that are being passed, and new ways that employers are addressing old problems,” Jack explained. “It’s a website that you should visit every week at least once, maybe twice, because you’ll see new information.”
